Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, applications, and services operated by Only Real LLC ("OnlyReal," "we," "our," or "us"). By accessing or using OnlyReal services, you agree to these Terms and to our Community Guidelines (app.only-real.app/guidelines), which are part of them. If you do not agree, you must not use the services.

1. Overview and Our Apps

OnlyReal builds tools for authentic, verifiable participation. These Terms apply to:

  • the OnlyReal website and its waitlist and contact forms

  • OnlyReal Photo & Video Capture, our mobile app for iOS and Android (the "Capture app")

  • the OnlyReal platform app, our full mobile and web application, currently in limited early access and not generally available (the "Platform app")

  • the OnlyReal web application at app.only-real.app

  • community participation, marketplace, and paid features, where introduced

Where a section applies to only one app, it says so. One account works in both apps.

Early access. Features of the Platform app may be offered to a limited number of members before general availability. Early-access features may change, be withdrawn, or be unavailable at any time, and we make no commitment about when or whether any feature will be generally released.

2. Eligibility

To use OnlyReal services you must be at least 13 years old. If you are under 18, you must have permission from a parent or guardian, who agrees to these Terms on your behalf. You must provide accurate and complete information, including your real name and date of birth, and comply with all applicable laws. OnlyReal may restrict or terminate access if eligibility requirements are not satisfied.

3. One Account Per Individual

Each individual may maintain only one personal account across all OnlyReal apps, unless explicitly authorized by OnlyReal. One verified phone number can belong to only one account, and your username is permanent. You agree not to create duplicate accounts, impersonate another individual, use false identity information, or attempt to bypass account restrictions. Accounts created in violation of these rules may be suspended or removed.

4. Verification

Both apps require you to verify your email address and mobile phone number. Phone verification is performed through a third-party verification provider.

The Platform app additionally requires identity verification, conducted through a third-party verification provider, before its community features are available. By using the Platform app you agree that OnlyReal may request identity verification; that the name and date of birth on your identity document must match those on your account; that certain features require verification; that failure to complete verification limits functionality; and that verification outcomes may affect account privileges. Business accounts, where offered, may require verification of the business and its representative. Verification procedures may evolve as safeguards improve.

The Capture app does not request a government ID. An account created in the Capture app must complete the Platform app's additional steps before using the Platform app.

5. SMS and Messaging

By providing your mobile phone number in an OnlyReal app and initiating a verification or security-related action, you consent to receive SMS messages from OnlyReal or a verification provider acting on our behalf. OnlyReal sends SMS strictly for transactional authentication and account security, including one-time passcodes. Messages are sent only when you take a direct action in the app, such as account registration, login verification, changing your phone number, or confirmation before sensitive account actions including account deletion. Message frequency varies with your activity. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for assistance. For support, contact support@only-real.app. OnlyReal does not use SMS for marketing, promotions, advertising, general notifications, or non-security communications.

6. Capture, Provenance, and Verification (both apps)

The apps capture photos and videos with provenance: a record of when, on what device, and, if you allow it, where a capture was made, together with cryptographic evidence that the file has not been altered since. Because other people will rely on that evidence, you agree to the following.

Genuine captures. You will only present as an OnlyReal capture media that was actually captured with the app's own camera, on your own device, by you. You will not:

  • modify, patch, or reverse-engineer the app; run it on a rooted, jailbroken, or modified device to defeat its integrity checks; or interfere with device attestation

  • simulate, spoof, or falsify location, time, or any other capture signal

  • inject, substitute, or alter media anywhere in the capture, upload, or verification process

  • alter a stamped copy, or remove, obscure, or forge the provenance badge, reference code, or embedded manifest

  • present a capture as depicting something it does not, present an old capture as new, or use provenance as evidence of a claim the capture does not support

What provenance means and does not mean. OnlyReal's provenance attests that a file is unaltered since it was captured with our app and records the capture's time, device signals, and, where allowed, graded location: A (verified, within 100 m), B (approximate, within 200 m), or C (no location recorded). The badge also records whether the producing account was identity-verified or phone-verified. Provenance does not attest to the truth of what the image shows, who or what appears in it, or your right to capture it. A grade-A location reflects the device's fix within a stated accuracy and time window, and may be unavailable or approximate.

Stamps and verification. You may prepare stamped copies of your captures for sharing outside OnlyReal. A stamped copy carries a visible provenance badge, the verification address app.only-real.app/verify, and the capture's reference code. You agree that OnlyReal may retain the original capture and its provenance data for as long as your account exists so that copies remain verifiable, including after you remove the capture from your DarkRoom. You also agree that when a copy is verified, OnlyReal may show the original to a viewer who is entitled to see it and, unless you have chosen to remain anonymous, your name. OnlyReal may decline to stamp or verify any capture that fails its integrity checks.

Sharing outside OnlyReal. When you send a stamped copy to another platform, you are responsible for complying with that platform's terms and for what you share. OnlyReal has no control over, and no responsibility for, copies once they leave the service. Where the Platform app offers a direct connection to another platform, that platform's terms also apply.

DarkRoom and limits. Your DarkRoom is a private library with a capacity shown in the app, and each upload is subject to a file-size limit stated in the app. It is not a backup service; keep your own copies of anything you cannot afford to lose. The apps keep a copy of each capture on your device until it uploads, and keep it if the upload is refused.

7. Media Safety Scanning and Content Review (both apps)

Every photo or video uploaded to OnlyReal is scanned automatically for prohibited content before it is made available in your DarkRoom, including automated image analysis and, where a hash-matching service is available to us, matching against databases of known child sexual abuse material. Items an automated system flags are held for review by a person, who may approve them, remove them with a warning, or remove them and restrict or ban the account. A confirmed match against known child sexual abuse material is removed and reported automatically. On the Platform app, text you submit, including direct messages, is checked automatically and clearly violating messages are not delivered. You agree that OnlyReal may scan, hold, review, translate, and remove content under this section, our Community Guidelines, and our Child Safety & Anti-Exploitation Policy (www.only-real.app/csae).

8. Enforcement and Appeals

OnlyReal may investigate activity that threatens the integrity of the services, including duplicate or coordinated accounts, fraudulent identity behavior, attempts to bypass verification or capture-integrity systems, automated or abusive activity, and manipulation of features. We may use security signals and automated systems to detect suspicious behavior.

Violations are recorded as strikes on your account. Enforcement actions may include a warning, removal of content, temporary restriction, a 30-day or permanent ban, loss of the ability to stamp or verify captures, and restriction of future account creation. We notify you of a restriction or ban by email with the reason and an appeal link. An appeal submitted through that link is re-reviewed by an automated system and the result is applied and emailed to you; you may ask for review by a person at any time by emailing contact@only-real.app. Reports you make about other members are handled by a person, and the member you report is not told who reported them.

9. User Content

You retain ownership of the photos, videos, and other content you create and submit. By submitting content, you grant OnlyReal a non-exclusive, worldwide, royalty-free license to host, store, process, scan, analyze (including AI-assisted analysis for safety and integrity), translate, display, and distribute it within the services, and to retain originals for verification as described in §6. This license exists solely to operate, secure, and improve the services.

You represent that you have the rights necessary to capture and submit the content, that it does not violate any law or third-party right, and that you have any consent required from people who appear in it. You will respect the people in your captures, will not film people where they reasonably expect privacy, and will remove content of an identifiable person who asks you to. OnlyReal may remove content that violates these Terms, the Community Guidelines, or the integrity of the services.

10. Platform Conduct

You agree not to post unlawful, defamatory, harassing, hateful, or fraudulent content; post sexual content involving minors, pornography, or non-consensual intimate imagery; misrepresent where or when something was captured; share someone's private information without consent; impersonate a person, business, or organization; post bulk or manipulative content intended to distort what the community appears to think; manipulate the services or their integrity systems; interfere with infrastructure or security; scrape or extract data without authorization; or reverse-engineer the services. The Community Guidelines describe these standards in more detail. OnlyReal reserves discretion to enforce them.

11. Artificial Intelligence Tools

OnlyReal uses automated and artificial-intelligence systems to scan media and text for prohibited content, detect duplicate or suspicious accounts, identify abuse and tampering, translate public content, analyze aggregate trends, assist moderation review, and, on the Platform app, evaluate responses to sponsored programs. Except for confirmed matches against known child sexual abuse material, blocked direct messages, and the automated appeal review described in §8, these systems do not make final decisions about your content or account without human review.

12. Advertising

Capture app. The Capture app displays promotional content from OnlyReal and, from time to time, from selected advertisers, served by OnlyReal from its own systems. The Capture app contains no third-party advertising software and no advertising identifiers, and no information about you is shared with advertisers. Advertisers have no relationship with you through OnlyReal, and OnlyReal does not endorse advertised products.

Platform app. Advertising in the Platform app, if offered, will be described in these Terms before it is introduced.

13. Purchases, Subscriptions, and Payments (Platform app, where introduced)

If the Platform app introduces subscriptions, in-app purchases, marketplace features, or payments to members, purchases made through the Apple App Store or Google Play are subject to that store's terms and billing, and other payments are processed by third-party payment providers under their terms. OnlyReal does not store full payment credentials. You are responsible for lawful transactions and for any tax obligations arising from payments you receive. OnlyReal may apply fraud prevention and verification measures to payment activity, may withhold payments where an account is under enforcement, and may suspend accounts involved in fraudulent or abusive transactions. The Capture app contains no purchases.

14. Private Notes (Platform app, where offered)

If the Platform app offers a private, password-protected notes feature, its contents are encrypted on your device with a password only you know. OnlyReal cannot read them and cannot recover them if you lose the password; recovery lets you set a new password, and previously written entries stay unreadable. You are responsible for remembering that password.

15. App Store Terms

When you download an app from the Apple App Store or Google Play, that store's terms also apply. Apple Inc. and Google LLC are not parties to these Terms, have no obligation to provide maintenance or support for the apps, and are not responsible for the apps, their content, or any claim relating to them. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS apps and may enforce them against you. You represent that you are not located in a country subject to a United States government embargo and are not on any United States government list of prohibited or restricted parties.

16. Intellectual Property

All design, software, branding, algorithms, provenance and verification systems, and other proprietary systems are owned by Only Real LLC. You may not copy or reproduce the technology, reverse-engineer the services, or use OnlyReal branding, including the provenance badge, without permission. Unauthorized use may result in termination and legal action.

17. Privacy

Your use of the services is also governed by our Privacy Policy (www.only-real.app/privacy), which explains how we collect and process personal information, including captured media and provenance data.

18. Termination

You may delete your account at any time from Settings in either app, or by submitting a request at app.only-real.app/delete-account if you cannot sign in; deletion is scheduled with a seven-day grace period during which it can be cancelled. OnlyReal may suspend or terminate your account if you violate these Terms or the Community Guidelines, attempt to undermine the integrity of the services, cannot complete required verification, or if we determine termination is necessary to protect members or the services. Termination may include removal of content, suspension of access, and restriction of future account creation. Provisions that by their nature should survive termination, including §§6, 9, 15, 16, 19, 20, and 21, survive.

19. Disclaimer of Warranties

OnlyReal services, including provenance, stamps, and verification, are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation, absolute security, that captures will upload or be retained, or that provenance will be recognized or honored by any third party. To the fullest extent permitted by law, OnlyReal disclaims all warranties.

20. Limitation of Liability

To the maximum extent permitted by law, Only Real LLC shall not be liable for indirect or consequential damages, loss of data (including loss of captures or private notes), loss of profits, or disputes arising from user-generated content or from copies shared outside the services. Total liability shall not exceed the greater of $100 or the amount you paid to OnlyReal in the preceding 12 months.

21. Indemnification

You agree to indemnify and hold harmless Only Real LLC from claims arising from your content, your captures and where you share them, your misuse of the services, your violation of these Terms or the Community Guidelines, or your violation of third-party rights.

22. Modifications

OnlyReal may update these Terms as the services evolve, including when the Platform app becomes generally available. Updated Terms become effective upon posting with a revised Effective Date, and the apps may ask you to accept them.

23. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.
